1. the Kommetjie Residents’ and Ratepayers’ Association (KRRA) represents more than a thousand households that would be affected by the proposed road development.
2. If granted, the application is likely to exacerbate congestion, the intersection being so close to the main Milky Way traffic lights
3. National policy seems to indicate that road reserve is considered public, but in this instance it would appear to be ceded for private access.
4. Ongoing and increased traffic congestion levels could negatively affect property values.

PROPOSED APPLICATION FOR SUBDIVISION AND REZONING IN TERMS OF THE CAPE TOWN MUNICIPAL PLANNING BY LAW: REMAINDER ERF 5142 KOMMETJIE, 25A KOMMETJIE MAIN ROAD CAPE FARMS - DISTRICT H
The landowner has entered into an agreement to sell a portion of erf 5142 to the neighbouring owner of erf 5144 Kommetjie
to provide a new dedicated private access road to the development on the latter. The purpose of the original application accepted in July 2023 was to, inter alia, extract the road portion from the existing subdivision approvals for erf 5142 Kommetjie before the expiration of the extended rights validity on 29 April 2024.
Given that that lapsing date has come and gone, the application now has to change to a subdivision of the portion to be the private road, with rezoning from Agriculture (the reverted zoning) to Open Space 3 for private road, and a sliver of road widening of Kommetjie Main Road (“KMR”) to TR2 (note that this could also be a deeming per section 16(3) of the DMS).
NOTE: The intention to construct the road (and subdivide the portion of land required) has already been advertised during the environmental basic assessment process to surrounding landowners (see environmental notice proof). In terms of section 113 of the MPBL, it is motivated that the notice already carried out during the NEMA process constitutes public notice for the purposes of this application and that no further public notice is needed.
This proposed road is to become the main entrance to Sea Breeze Village (the estate on adjacent erf 5144), and is intertwined as a condition for future phases of said Sea Breeze Village, in accordance with the traffic impact assessment.
